WHBU “Cash Wheel” Promotion

1) Contestants must be 18 years of age or older

2) No purchase necessary.

3) The WHBU “Cash Wheel” will contain the names of participating sponsors. The contestant will be read the names of the participating sponsors, and will be required to choose one. The WHBU “Cash Wheel” will be spun and the sponsor chosen at random. The contestant wins, if their choice matches the sponsor selected on the wheel.

4) The WHBU “Cash Wheel” game will be played once between 6am and 9am each weekday morning, April 1st to May 3rd.

5) The “clicking sound” of the WHBU “Cash Wheel” will be played on the air, to alert listeners to call the station. The first caller to 765-378-2086, who meets eligibility requirements, will be able to play the contest.

6) A person remains eligible to play the contest, until they win a cash prize or are awarded a “consolation prize.” At that point, they are not eligible to participate in a WHBU contest for the next 30 calendar days.

7) Winners of prizes valued at more than $100 or more will be obligated to sign and return an affidavit of eligibility and provide their social security / tax identification number before receiving the prize.

8) If a cash prize is awarded, the winning contestant must submit required paperwork to our Daleville business office. The cash prize will be awarded by Backyard Broadcasting check on or about April 15th, April 30th, or May 15th 2008.

9) Failure to comply with any requirements of these rules will result in the winning entrant being deemed ineligible for the prize.

10) Backyard Broadcasting reserves the right to make the final determination as to the eligibility of all winners.

11) In all contests from Backyard Broadcasting, the decision of the judges is final.

12) Anytime you call the radio station studios you assume that your call will be broadcast or recorded and you grant us permission to broadcast the call or record if for later broadcast.

13) As a winner of a Backyard Broadcasting station contest, your voice, name and/or picture may be used for promotional, broadcast, or internet purposes.

14) In the event the winner is subject to or the subject of any order or legal process issued by any governmental agency having jurisdiction over the affairs of the winner (i.e. garnishment, child support order, judgment, lien, and the like), Backyard’s delivery of the prize to the official representative of the governmental entity claiming a right to the prize shall be thus deemed as the station awarding the prize to the winner. Backyard and it’s stations shall be entitled to rely in good faith, upon any documents presented by the representative seeking to collect the prize in lieu of the winner. Backyard stations shall not be liable for any claim by any winner for damages incidental thereto.

15) Employees of WLBC, WERK, WURK, WHTY, WHTI, WHBU-AM, WXFN-AM and/or Backyard Broadcasting or Sabercom of Indiana, its parent corporation, Backyard Broadcasting, Inc, their advertising agencies, affiliates, contest sponsors, employees, and immediate families of each, and principals and employees of all media of mass communication within a one hundred mile radius of the Backyard radio stations main studio are not eligible to win any contest.

16) All federal, state, and local laws and regulations apply. Contest is void were prohibited.

17) Backyard stations reserve the right to disqualify any winner if any contest rules are violated in any way.

18) The radio stations of Backyard Broadcasting, and its parent corporations as described above, assume no liability for any matters, situations, repairs, or incidents arising from any aspect of any prize awarded in any contest on any Backyard radio station and its parent corporations as described above, their advertising agencies, affiliates, contest sponsors, employees, and immediate families of each absolve themselves and shall be held harmless from any action or liability arising from any contest or prize awarded in any contest.

19) As a licensee of the FCC and a trustee of the public airwaves, Backyard reserves the right to interrupt and/or discontinue any contest or promotion (and not award the offered prize) at the discretion of Backyard management if world events, the national mood, or public safety so warrant.

20) Backyard reserves the right to amend the rules to any contest at any time. The judges’ decision is always final.

21) For any contest requiring phone entry you must use only the following number unless otherwise specified: (765) 378-2086. The person operating the telephone at Backyard Broadcasting has the final decision as to who is the winning caller.

22) Backyard radio stations shall have no responsibility for failure to win or claim any prize based on difficulties with telephone, facsimile, email, or internet difficulties, or any circumstances in any contest.
